Terms of Service

1. Provider

The AviaProof service ("Service") is provided by Margherita Roncone, Spanish CIF Y9979373D, with registered address at Calle Pelayo 3, 6B, Las Palmas De Gran Canaria, Las Palmas, Spain ("we", "us"). Contact: business@aviaproof.com.

2. Acceptance

By creating an account, generating a candidate link, or uploading documents through a candidate link, you ("User") agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

3. Description of the Service

AviaProof allows aviation sourcers to define positions, request documents from candidates, and have those documents automatically validated through an OCR pipeline (identity, qualification, expiry). Candidates may upload documents from their device or, optionally, import them from their personal Google Drive.

4. Accounts

You are responsible for the accuracy of your account information and for safeguarding your credentials. You must promptly notify us of any unauthorized access. You must be at least 18 years old and authorized to act on behalf of your organization.

5. Acceptable Use

• Do not submit forged, fraudulent or unlawfully obtained documents.
• Do not use the Service to discriminate against candidates in violation of applicable law.
• Do not attempt to reverse-engineer, scrape, overload, or circumvent security controls of the Service.
• Respect the privacy of candidates and process their data only for legitimate recruitment purposes.

6. Candidate Data and Google Drive

When a candidate connects their Google Drive, the access token is held in their browser session only and is never stored on our servers. We download only the specific PDF files the candidate selects. Sourcers acquire the role of independent data controller for the candidate data they receive and must comply with the GDPR and any other applicable law.

7. Intellectual Property

The Service, including its software, design, trademarks and content, is owned by Margherita Roncone and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain ownership of the documents and content you submit.

8. Fees

Where the Service is offered against a fee, prices and billing terms will be presented in-app prior to purchase. Fees are non-refundable except as required by mandatory law.

9. Disclaimers

The Service is provided "as is" and "as available". The OCR pipeline assists with verification but does not replace the User's professional judgement. We do not warrant that the Service will be uninterrupted, error-free, or that every document classification will be correct. The User remains responsible for final hiring decisions and for compliance with EASA, civil aviation authorities and labor regulations.

10. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claims arising out of or related to the Service is limited to the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or data. Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g. fraud or gross negligence).

11. Termination

You may close your account at any time. We may suspend or terminate access if you breach these Terms or if required by law. Upon termination, provisions that by their nature should survive (e.g. IP, liability, indemnification) will remain in effect.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Spain, without regard to conflict-of-laws rules. The courts of Las Palmas de Gran Canaria shall have exclusive jurisdiction, without prejudice to any mandatory consumer protection rights you may have in your country of residence.

13. Changes

We may update these Terms from time to time. Material changes will be notified via email or in-app notice and take effect upon publication.
